He told me at the last minute that I could not move because the lease and checks I sent to him in the mail had not reached him yet. He told me he would call me back and never did. I understand about not having the signed lease yet, but I have to be out of my apartment now and he has left me homeless. Should I realize now that my new landlord is an unprofessional asshole who wouldn't even work with me and keep his agreement to let me move in this weekend? Or should I give him the benefit of the doubt and understand that he doesn't have a signed lease and therefore cannot let me move in? I am very frustrated and don't know what to do.

If he is local meet him to sign another copy of the lease, stop payment on your check and give him cash or a certified bank check. If he is not local have him fax you a copy of the lease, sign it and fax it back. Wire him rent money thru western union. He just wants to be sure he is getting a signed lease and cash. You can't blame him for that! You should have sent the lease and check so it reached him in plenty of time.

What a bad situation. If you did sign the lease, and sent a check, then you are committed to the apartment. I don't believe a landlord is required to let you move into an apartment without a deposit or rent check. You could stop payment on that check, write him a new check and present it in person. If he has another copy of your lease in his office, you could sign that. Then stop payment on the original rent check or have him return it to you when it arrives and tear it up.
