?? It depends upon what the summons is -- is it a hearing setting child support? Then if that's the case, the court may say "he didn't show up, he's got nothing to say," and will believe the custodial parent's version of the facts. Sometimes the court will still refuse to act even if the other person is in default, but that's rare.

The important thing is to GET THIS FIXED NOW. Call an attorney; ask for legal aid help; if none of that works, write the judge and say you're looking for an attorney to help with the child support issue. Don't just do nothing.
