If it is a rule at the restaurant; then it is OK. In my opinion its not OK, because when I go out and spend my money I would like to reward the person that gave me a great service. If the people working with them, the bus boy...etc gave them good service, then they should reward them in return everyone will work to its potential to get some of the tip.

I never worked as a waitress but its hard work. Everyone should be an adult and responsible for reporting their own income they do not need a babysitter.

I don't see why it wouldn't be. Yes, you have to report all income for IRS purposes. But, it's not your income until you take it home. I know some places you split tips with the other waitresses, the busboy, and the chef. Some places you split the tips with the owner. Either way, you wind up with some amount of money that you own at the end of the day. That's what you have to report. I also know someone that leads a band. He got the money for each performance. He then divided it up. He, and they, reported how much they wound up with, not the total for each member. And, he kept very exact records stating that because it was mostly a cash business.

I don't know if its legal but I HATE it when restaurants do that. I use to make great tips because I would work my butt off and then I'd have to split them with someone who worked at a snails pace. That was so frustrating.
