It was due by January 31st. This creates a problem that effects you, but it is not your problem. You can do 2 things. File for an extension, or file a return based upon a good faith estimate of your earnings. Note on your return "Despite numerous requests, W-2 form not received." Without a doubt, anything you do could create a problem with your return. However, you must file. If your estimate of earnings is reasonable based upon last year's return, it will not automatically trigger an audit of you, although it will trigger action against your former employer. You have limited options. I'd file without the W-2. They broke the law, not you.

Report that employer to the Labor Board, and get an attorney who specializes in labor law! That employer is in violation of the law, as you should have received your w2 by january 31st.You yourself will know the figures from your last pay stub, so you can file your return and tell the IRS that your employer did not submit a w2.

Call the IRS and tell them. They'll tell you what to do next, or they will contact your former employer. It's a law that employees recieve the W2 by the end of Jan.
