It would probably depend on what state or province you live in. In Ontario the minimum wage is now $8. per hour and I think $6.75 for waiters. Call your labour board and find out.

In the US it is $5.15/hr. Congress is looking to change that now...both Houses have passed their own bill and now must negotiate a final bill for voting...then to the President for signing.

However, states may pass their own minimum wage law and supercede the federal law. In your state, it may be higher already.
