First of all, why did you stay in the Phillipines for a few months, that may be why your husband divorced you and took your daughter. It could be called "abandonment" in court. Sounds like there is more to your story than you are putting out. I hope your daughter doesn't suffer over you and your husband's immature handling of this.

The truth of the matter is that you do not even know if your daugther is still in Ohio. Contact the FBI and see if they can help you. The FBI handles cases of missing people when the case goes over state lines. They also do child abduction cases. Since there is no hard proof that they are still in the same state, it may be possible to get help.

Divorces just can't happen when you're away. Your husband would have to claim that you abandoned the family - in which case he would have to prove it. Or that you are dead - and that has to be proved again, or a certain amount of time needs to pass without contact, usually 7 years.

If at all possible find a copy of the divorce perceedings. See if they are even legal. He may have just sent you papers that looked offical but weren't. You will most likely need to hire a lawyer to help you - especially if the divorce was fraudlant - for any reason.

SEE A LAWYER or attorney (as they are called in the USA). GO AND see ANY (even a bad one). Ask him/her what to do and where to go.

I highly recommend you see a community legal service centre, because they are very good on providing you advice like this for free. They will empathise with your situation, if you have no money.

Secondly, if you see a family lawyer, make sure he/she is reputatable. FIrst, go to the law association in your state. It will be like the Ohio Bar or the Ohio Law institute - (it is called the Law INstitute of Victoria where I live).

Thirdly, lawyers are out there to earn a living. Some won't be very good. They might stuff up your case. They could be expensive, they could lie to you etc. (it rarely happens over here, but in USA anything could happen). Just be safe, and don't do anything stupid with those lawyers.

Goodluck, and remember, the law will do what is best for your daughter. Regardless ofyour situation, you have to ask yourself what is best for your daughter.

A lawyer will be your only solution. They can authorise the search of your daughter via the state authorities, using police infrastructure. It's a lot easer than doing in by yourself.

I guess your rights and what you can do depend on if you are an American citizen or not. How can your husband divorce you without your knowledge? Also, why did you leave your daughter with him in the first place. Maybe he told the court that you abandoned the child. You need to get yourself an attorney and or hire a private investigator to find out where he is. Good luck this is terrible thing for a father to do for the child and you.

It sounds like your husband kidnap your daugther.. contact the police and make something happend.. go there if you have to where you think your daughter is.. it has to be someone to help you this is a nightmare.. i dont have much information im sorry but the first thing i would do is look for somekind of support group concerning this matter and they usually have answers to this type of horrible situation my heart goes out for you and I know this is taking so much of your happiness but this man broke the law of the united states and someone in this country should have something to do about this, educate your self in this type of matter.. dont give up the search of your child.. good luck and may the lord help you reunite with your child. good luck.

He cant just up and divorce you. there are records and the courts have to listen to you and if he is in violations of a court order to produce the child then let the courts deal with him. get your facts in order then get a lawyer and get a hearing with the judge that granted him the divorce..

Talk to the police immediately and file a missing persons report. Talk to them immediately for your child's sake. Good Luck.
