I know HIPPA protects information, but who owns it? More over if the hospital is a State entity can those records be provided in an open records request if the patient is deceased?

By law, if you provide service, your records of this service is your business data, therefore its confidentiality is your responsibility.

So the records belong to the hospital.
To get a copy of any medical file, you need to meet several requirements usually already in place within the hospital system.
If it belongs to your deceased relative, get your lawyer to handle the matter for you. A subpoena can be issued by a judge to request a copy of this record.
Different countries have different rules but the variation is usually not that wide.The rule of thumb is that these institutions will be wary of any possible lawsuits.

clearly, in the United States, the records belong to the hospital. This answer is incomplete, however, as the information contained in the records belongs to the patient. The patient or his legally appointed representative has the right to access the records. They even have the right to photocopy them, and the photocopy of the original record becomes their property. The original record, however, must be retained by the hospital.

It depends. In a case where patient is an inpatient, then the records are owned by the Hospital. If the patient is treated on consultation then patient owns. For that matter even if the patient is registered as out patient even then the records are to be kept by the hospital.
