My old boss sold the company. The new bosses have changed our working hours (longer), sick pay, holidays etc. We have not been given a new contract to sign - is the old one still in effect?

Hi Fluffy,

If you are in the UK.

When the new owners take over the company they do so with the existing employees under their existing contracts of employment. These contracts cannot be changed unless agreed to by the employee or by collective agreement through a union recognised by the employer for the purposes of collective bargaining.

If the new terms and conditions are not to your advantage go to an employment law specialist or the union. There is specific legislation in place to protect you under the Transfer of Undertakings (Protection of Employment) Regulations 1981 s.5(1).

Difficult question Fluffy. The new company should have had your old contract consolidated under the TUPE regulations. Once you have worked under the new contract for a length of time, you are deemed to have accepted the new terms and conditions. You need legal advice.

Your old contract is still in force, until the new boss gives you a new one to sign.

yes, the terms of your original contract still stand. i have an employee working for me, he's been with us twenty years, he still gets the entitlements of his original contract, double time for bank holidays , lieu days etc. make sure you have a copy of your original contract.

yes, a contract is a contract, and unless you have been informed otherwise, they have to abide by it as you do
