If the person was found innocent, was not charged, and sent home, he's not a thief ?

Why are you still treating him as if he were?

If you found it out from him, that surely shows
a good degree of honesty on his part.
What do you think? That's what matters.

It will be depend on the type of job and the hiring manager. A criminal background check will show the arrest so it will be important to put the arrest on the application as well as an explanation including the fact that the case was dismissed. If the arrest is not on the application along with an explanation and a background check is done, the application will be rejected forthwith because it would go back to the applicants' character in terms of honesty. I fired a few people because they were not honest about arrests in their background. The crimes were trivial however, they did not put them on the application and it came up in the background check. I could not trust them because if they were willing to lie about that how could I trust them not to lie about work completion, etc.

If what you are saying is true: "he was innocent" then why would you ever consider it?

If someone just told me they had a theft charge and it was dismissed that does not necessarily mean he was "innocent." It may just mean he took a plea bargain or they did not have enough evidence to prove it.

If the job requires a high degree of honesty, deals with money or peoples financial info then I would not hire him.

if it was dismissed... then not an issue. Focus on you good qualities... but be sure to address any legitimate questions about your past honestly.
