sent the item i won was sent to another person and the told me this.......

so glad you got my email.
I got yours
I just got a e mail from the girl that got the wrong
shoes and she will not send them back.
Just happens that she likes them,
even though they are the wrong size and shoe!
I don't know what to do!!
I can give you a full refund or show you what
I have in size 6's.
Right off the top of my head I have
a sz 6 BCBGirls shoes that are croc print
and worth alot more that the Michael Antonios that you won.
I have your e address and will send you a picture .
I will also look at the others that I have and get back with you!
I am so sorry.
I begged her to send me the shoes back and she said
I recieved the wrong shoe and love them,
so I am gonna keep what you sent!
So check your ebay in a bit and tell me what you think.

I think you need to go to eBay officials with this one. Print out a copy of the email and keep it in your files, and ask eBay their opinion. The seller cannot do this to you, because when you bid and won the shoes you entered a contract with the seller. You kept your end of the bargain (did the seller give you positive feedback?) so it is now the seller's end of the deal to send you the correct shoe. Since you have received nothing for your confirmed payment, ask eBay if they can intervene or step in to aid with the situation so that you receive the shoes that you ordered. Some sellers you have to watch out for, they may do this on a regular basis in order to trick customers. If/when you receive the shoes, do not leave the seller positive feedback. If you are feeling Very nice, leave neutral. No one needs such a bad eBay experience. If the situation escalates, and you are completely unsatified, leave them negative feedback (leave a Very good reason, because they may try to explain it away). It is also your duty to warn other potential buyers that this person is sloppy with their paperwork.
I really hope this helps, I have had good experiences with eBay, and I hope you get your shoes all right, I know how hard it is waiting!

That is unfortunate, but it does happen. This is the seller's fault. Because the item is no longer available, and she has offered a refund, I would take the refund and try and find the shoes from another seller. As long as the seller offers a refund there is no recourse thru eBay. Good luck!

Tell the Seller you are going to post negative feedback. Demand a refund for merchandise not recieved and report them to e bay. Deffinatly post negative feedback and let them know you will also have all your friends post also

Mistakes happen and yes it sucks, but she can't send you something she DOESN'T have. She can refund you or offer you a pair you like.

YOU can't have a pair of shoes that she's mailed to someone else and even though she made a mistakes you should forgive her she's only human and she's doign her best to correct the mistake she made.

Well, that 's your choice. I would just ask for my money to be returned. If you have any problems, report her and give her/him bad feedback if they aren't forthcoming with your money.
