i think my marriage license says or implies which one of us is male and which is female, you would probably not be able to have it considered legal because it would be a falsified document. plus i think we had to show our drivers licenses and social security cards to get the license, so if you used someone elses you wouldn't be considered married anyway.

too sad that you just can't be able to be married without trying to figure out to"get away with it". i'm really sorry cause man, that would be so awesome if you had found a way around such a stupid law.

i wish you all the happiness in the world with the person you love, i know this sucks, but at the end of the day, it really is just a piece of paper.

Umm...when you get married, and you file for those papers and stuff you know to have your marriage recognized by the state...you kinda need your birth certificate or some other form of Identification...and they kinda know what sex you are. So you couldn't somehow dress up like a man or woman and trick the state...unless they were blind mute and deaf.

Many place consider a marriage between a transsexual and a person of the same sex still a transsexual marriage. For example, a woman marries a man who is transsexual, this is fine because hes a man and shes a woman, but if a man is a transsexual and he wants to marry another man, its a gay marriage because thats a man and a man.

If you get a sex change however some places find that after the sex change you can marry your original sex, but some places still say that that is a homosexual marriage.

Sounds like fraud. But...you could start out as someone of the opposite sex, get married, and then go through a gender transition and legally become the same sex. That's what I want to do but I think my transition might be happening to fast!

Legally in the US I believe so. However, a post op transgendered person is legally declared the opposite sex from their birth sex and can marry the sex of their birth. In some cases opposite sex married couples, where one has the switch surgery can remain married even though one is now legally the same sex as the husband/wife. But same sex couples can not marry. Odd, isn't it. I saw this on Oprah.

Illegal--it depends on your state laws that govern this form of "sex or sexual fraud." Many states have had to enact laws that deal with sexual fraud involving people who don't tell their partner their true sex. Some states make it a criminal act that has specific fines and even jail sentences. Other states prefer to leave it in the realm of the civil court and keep it under tort law.

At the very least such an act is unethical and the person who has been fooled can be subjected to ridicule and may act out of rage and even kill the person committing this type of fraud. The person who is doing the fraud may be in need of a lot of mental health counseling. If they feel driven to commit this type of "crime" or "civil fraud" the only outcome there is is a bad one! I would implore them to find the strength to live the truth.

It's fraud and hence illegal; if your true sex were to ever be found out, the marriage would be null and void (until gay marriage is allowed).

But lots have people have gotten away with it, particularly in the past- Annie Hindle dressed as a man, gave herself the name Charles, and under that guise married her dresser, for example, in the 1920's. But I don't know that it would fly today.

I say don't try it.

the right for gay marriage must be there for anybody. Why would you want to end particular people from helping you? immediately and bisexual people can actually have a experience of fairness. gay marriage can practice to bisexuals, definately. Many bisexuals lean in route of an similar sex or have fallen in love with someone of an similar sex.

Yes, that is fraud. Marriage is a contract between two people. One thing that voids a contract is fraud. If the other party is not satisfied you can be sued, arrested, etc. The marrital contract is void if you pose as someone you aren't. For encouragement, listen to ttb.org.

The ceremony and relationship would not be illegal, but you would have to be careful about filing documents, and you could not get public status. Th IRS for example, frowns on falsified tax documents
