Back when my daughter was 5 I started down the road to obtain custody from her drug dealing mother. She was nearly 7 when I finally won. $70,000 dollars in court costs and legal fees nearly bankrupted me.

Even though her mother was repeatedly arrested, left our daughter with others for periods of time up to a couple months and was found several times living in her car in other cities I still had a horrid fight and all she really had to do was show up in court.

After the judgment finally came down in my favor she never paid a dime of support. The district attorney wouldn't even try to collect, they flatly refused because I wasn't female or on welfare. Ther was a court order but the state of California refused to uphold the order of its own courts.

No, the system doesn't favor the mothers.

Why do not you ask yourself that question?. Did you not feel a special bonding love for your mom. She carried you nine months, her body had a painful delivery God know for how many hours of excruciating pain, she gave you your first kiss and fed you and nurture you with her breast. You disfigured her once beautifully shaped body, she stayed up worried, she cried and so much more that a book will never fill. A mother love is unique. Look at the statistics. When a child grows up and lets say he has AIDS most of the time the father end up leaving the family and the mom is always with you no matter what. I am not saying there are not bad mothers out there, there are plenty, but the world is full of the good ones. God bless them all. Having said that, when a judge weigh his decision which is not an easy one, where do you think a child has a better chance.? with the mother of course. Another thing when a men has the child and he re marries. Do you actually think that she fell in love with your child or you? yea she takes the child because she wants you, but as soon as both you have children observe how she treat him then. I hope step kids can write to you and tell you. If they were loved more by the step mom or the real mom. To most good mother No men comes between her and her offspring's.

Because in most cases the mother has been the main caretaker for the children all along and thats why the kids should be with her. Now when its different they will make different decisions and more men are getting custodial custody. I think there used to be a general feeling that a man couldnt handle that job. That has changed a lot in the last 30 years.

I believe that men will have equal rights with custody in proportion with their equal assumption of the caretaking of the children in the marriage. As more women stay home(and many men encourage this) it will be more likely the woman will assume custody. The Mr. Moms that so many make fun of-have the best change among men of actually getting custody. It's not about discrimination as much as equality.

Bob-about 60% of women don't get their court ordered child support either. It sucks that the courts won't help but is not just a man's problem!

Because it is mostly mommy who is more capable of taking care of the children. However they do not always go to the mom - especially older children.

Older children are very often asked which parent they would be the happiest with or which parent they wanted to stay with and why and their views and opinions are taking into account

for younger children it is mostly mommy who has the patients and ability to provide their care (not saying that daddy couldn't) it is just the way it is and discrimination doesn't come into it because if mommy isn't capable of taking care of the kids then daddy will be awarded custody of them.

Its all about whats best for the kids and unfortunately in most cases that is to say with mom

Because its been widely believed for many generations that a womans place is in the home. They werent allowed to vote, hold most jobs, etc etc. Their job was to breed and raise children because thats all they were designed for (and to look pretty at dinner parties). Therefore they are the obviously the best choice to continue to raise the children. Were just reaping the results of years of discrimination against women by men. Sorry
I dont actually believe that a mothers care is always best. I know some women who shouldnt be allowed to have fleas, let alone children

emm when i got divorced my daughter was about 5 years old her mother said that there would be no way i would raise the child because i was a man, well when all went to court the court even said thier was no way i would be able to raise the child again because i was a man some how i managed to allow the court to put me on a 6 month trial after 6 months we went back to cour and the socail worker said i had done a great job but in the end the judge ruled against me so she went back to her mother who put so much posion in to my daughter about me that in the end my daughter decided that she no longer wanted to know me and all comunication stoped about 6 years ago i now find out via friends that my daughter is in to drink and drug and sleeping around how i wish i could get hold of that judge and show him what has happend i still maintain if my daugher was allowed to stay with me she would be a decent person

excellent question considering all the news lately regarding women and state of mind, inclusive of Anna Nicole Smith ( RIP ) and of course astronut Nowak. Women drowning their kids in bathtubs, in cars driven into lakes - and this just for the first 6 weeks in 2007! Maybe the idea I suggested ten years ago about having to pass a test before becoming a mother, is now a great idea ( the reason I say only the mother is because women have decided they don't need the father around these days).

I think most mothers could look after the children better than the fathers, they seem to be doing a good job in husband and wife relationships looking after the kids while dad is at work and they are better organised.
Discrimination i think not.

The mom mainly stay home with the kids, so the courts see that the men is making the money ,consequently they allow men to work and pay child support ,alimony etc.. and let the kids with mom.But with change in roles !!!! some dads are getting the children.!!
