It's illegal in EVERY state to carry a passenger who is not seat-belted.
Since there is no seat securely bolted to the frame/body of the truck in the bed, and there is no means to strapping the person to the non-existant seat, you are illegally transporting people.

There are probably other, more specific laws preventing it, too.
