Directions: decide if the Constitution allows this situation, then write which article and section supports your decision. Here's the situation:

The current size of the U.S. House of Reps. is 435 members. This number was set by Congress in 1929. However, the population in your state has grown by 40% over the past two years. Your state legislature recently passed a law that added one additional representative to the U.S. Congress. Your state court judges approved the law. A statewide election was held, and your friend was the winner of the new seat.

First of all Chipmunk I am not doing your homework for you. You will never learn anything and grow up being one of the educated ignorant of this country if I do.

Second. Please go to http://www.law.cornell.edu/constitution/constitution.articlei.html#section2

and read the first four paragraphs.

You will find that the Constitution allows for adding and subtracting the number of members sent to Congress from each state BASED ON THE POPULATION OF THAT STATE. The States do not have the right to change that in any way, so they cannot "approve" the law or "pass a law to add an additional representation."

The states CANNOT TAKE AWAY FROM THE U.S. CONSTITUTION, it can only pass laws that affect the state that are not enumerated in the Constitution.

Look at article 1 sec. 2 part 3.

The answer depends on when the last census was taken. And if 40% increase in population is an increase of 30,000 people or not.

the answer it would not be allowed.the views of a state has no inpact on the federal level. to add more would need the US congress to change the electrol college. all seats in the house are based on the electrol votes a state recieves.and the electrol college changes every 10 years after a census. back in the 1980' s many states passed laws limiting the amount of time a person could hold seats in congress. this was challanged and was the court struck down the laws. stating the states can limit the amount of time someone could be elected on a state level but would need the Constitution amended to limit the amount of time a federal seat could be filled.

in article 1 of the us constitution, each state's representatives are chosen by its states' citizens. furthermore, the article states that the number of representatives is directly proportional to the states' population, hence according to the constitution the law passed by the state's legislature and approved by the state courts, the increase in the number of representative should be allowed. now go out and party with your friend who won the new seat

To add a rep. to a state is done by the congress of the U.S. and not the state. So the election in not constitutional.

Having more Reps will not give government more power it gives more power to the people, that is what is meant of the Constitution to limit power of government.
