we have never been late with our rent before this month*(feb.) my check wasnt deposited in the bank yet what are our rights and how long of a process is this?

Check with your Mayor's office; see if there's a Mayor's Office for the Disabled, also contact your Umbudsman/woman (Public Advocate) and also contact any and all legal services. Before you are served with an Court Order (Eviction Notice) you should have been served with a Dispossess whereupon you usually have 30 days wait before going to Landlord/Tenant Court to explain why you should not be evicted and/or reasons for your tardiness. There are procedures that must be followed. Also, you may be the victims of discrimination (as disabled individuals). Check with an attorney (you may even have cause for suing! Also, contact a few newspapers and a few television news reporters ("Action Reporters") and let them air your story! A bit of negative publicity for your landlord may cause him/her/them to stop harrassing and discriminating against you. Good luck and best wishes.

Soory to hear that. Eviction does not always come from late rent payments. Do you have a lease? If so then they can't break the terms of the lease. Are you on a month to month? If so then they can evict you for no reason at all. They just have to follow the proper procedures.

Look at it from the owner's point of view. Say I own a house that I now want to sell. I have a buyer, but they want it to live in not as a rental. To complete the deal I have to get the tenants to move out. If I have a lease with the tenants it stays in effect even with the new buyer as a right of succesion(I don't think that is the actual term but close). Now if you are on a month to month I want you to move, but you don't want to. What are my options? The only avenues I have are to bribe you or evict you.

Talk to your local housing authority or other such agency. They will be able to help you.

Depends on what state you're in. Being disabled doesn't afford you any special rights. You still have to pay rent.

Eviction, as a general rule, requires a certified letter from the landlord, and then a grace period of 30 - 90 days to get the rent caught up. Your state laws may be different than that.

did you pay your rent when you got your check? talk to the landlord.. an eviction in most states take about 6 weeks,,, you do not get special treatment because you are disabled>>> go to your local news media
