I have a friend who has a child with a rather irrational woman. She told him the baby was his but when they broke up, she said she lied about the baby being his. He would like a test to be done but she refuses. What are his rights?

Yes, you can indeed get a paternity test done when the mother refuses.

Go to the court and file to have the test done, usually have to have a lawyer to do this. If they are foolish enough to refuse with the court telling them to have it done - they are looking at fines and possible jail time along with contempt of court charges.

He can hire a lawyer and take her to court. It will be court ordered and she can not do anything about it then. He can also petition for his rights as the dad if the test comes back he is the dad. He can also be made to pay child support if it turns out the child is his. Good Luck!!!!

He has to go to court and get a court order for the paternity test. If he is listed on the bc as the father this will be much easier.

If he wants visitation or custody apply though the family court. The court can order a paternity test .

Men have very little rights when it comes to children born outside of marrage. It's all up to the woman. If she says it is his then they ( Welfare/Child support ) will go after him until the end of time. If she says he is "Not" the father then he is out of the picture. Very unfair but that's the way it is. ( Note: Why was he hanging with a woman who is irrational anyways?)

Yes, like the person above said, he can get the court to compel the mother to allow the child to submit to a DNA test. He will probably need a lawyer.

He has to go to court and petition for a paternity test - he may have to pay for the test himself.

He can file an injuction to force paternity. He does have rights to know if the child is his or not. Especially the given history.
