If he owes arrearages and the state has put a garnishment in place, they will either send him a letter or let him know when he files his taxes (federal and state can be garnished). I suggest he just file and if he owes, it is a good way to get the arrearages down and support his children. That is what child support is all about. Just get it over with and be happy your children have money. If he avoids filing because he owes arrearages, then he is just another dead beat trying to fight the system.

If he went before some guy it is most likely the Attorney General office. They will garnish his Tax return and if that does not catch him up with all back child support then when he does get a job they will garnish some of his paycheck. The guy entered the info into the system they got him, DEAD BEAT DAD!!!

For child support and maintanence enforcement, the process is setup with the original hearing being present or not, an amount is set based on number of children, gross income. From here it is up to the deptor to assess personal cost of living, and expenses. These will allow for the second hearing as to any deduction allowed on the base rate set forth by the courts. Once these have been set and if the debtor falls behind the maintanece enforcement will immmediately apply to the court to apply garnishee to any and all income the debtor is and may recieve, up to 70% of gross income, and 100% of excess income such as tax refunds, lottery winnings upto total of arrears.

If he is behind in his payments, the mother can go to court and the court will issue a writ of garnishment. This can apply to his paycheck and his tax refund. I suggest checking with the local District Attorney as regulations vary from state to state.

I am not sure if I quite follow your question.If he owes child support odds are his taxes will be garnished. If he is getting a new job, he has to inform the employer that he needs to pay child support. I hope this helps.

well the honor system doesnt work, thats been proven. thats also why everything is linked/computerized regarding child support and the state and federal government passed stronger laws for it.
they are tired of parents not paying for their kids. they are tired of paying for them too.
so, if a garnish has been ordered, they send a letter to the employer in which he has to take out the child support from his employee's check.
