My son lives with me for 9 moths of the year. I provide all the care, and up keep. His father, pays very little in child support (less then 300 a month.) There was nothing in the court order stating who can claim the child. In the past I have let him claim our son every other year. Due to some changes. He has 2 other kids that he can now claim. I feel that I am losing out on money, that would be a great help with son.
I did feel out paper work stating he could claim him, how do I change it. (that was 4 yrs go) Help!!!

If there is nothing in the papers stating who gets to claim the child. Since he lives with you, you should claim him. Word of advice, claim him before your ex does.

Without going to court and making the change there is probably nothing you can do unless you talk to your ex and tell him you are going to start claiming him every year because you are the one supporting him more than six months out of the year and you feel you should be getting the tax deductions on a yearly basis since he has two other children to claim. Try to keep it cool between the two of you and make him see your point. If he has paper you filled out is it a legal paper that was filed or just a written paper you signed? You might want to consult with an attorney on this to make sure you do not get into any trouble.

Who has primary Custody gets to claim him! Then I suspect it would go to the one who has him the most!

As he pays child support, I can assume you are the legal custodian!

Just curious about why you let him claim your child as a dependent! It is going to look awfully funny when he claims him as a dependent, and then writes the child support off of hisr taxes. That would seem to me to be a big red flag!

You don't need to change anything, but feel free top consult an attorney!

I would call my attorney and ask this question. I don't know how you go about rescinding that form. :) Sorry

I think its fair for every other year. My ex does not pay a dime in child support but in our divorce i said every other year was fair............................. He does pay some supprt.
