Yes, provided you can show that you are actually paying the rent to your mother by means of a rent-receipt which gets reflected in her income for that year, whether she files or does not file income-tax, depending on her total income.
Many of the babus in govt. offices entrusted with the job of deducting income-tax at source are unaware of the above and may disallow you from claiming this deduction. Never mind, you can still claim it while filing your returns for a particular FY by attaching the above receipts and claim a REFUND. You will succeed, more so if you are disclosing the income recd. by way of RENT for your own house given on lease.
Nowadays, you also receive the refunds faster from the IT dept. so it might be more prudent to employ the 2nd means than wrack your brains with an unobliging and ignorant babu sitting in your administrative office.

As per rule 21A of the incometax rule, any accomidation which is owned by the assesse relative for which the assesse has not paid any rent, excemption u/s 10 (13A) of the income tax act is not allowed .since u will not get excemption for HRA..

Yes, if he can produce a rent receipt from the mother. If the mother is not a tax payer, it may not affect her.
