Yes and he has the right to remain silent. All Mimes should be arrested for being annoying.

They don't really have to, because when they slap the cuffs on that sucker isn't going to say anything! Sometimes if the cop is tough he will whip out his invisible billy club and smack the mime around. You know, rough him up until he pretends to scream. I guess most mimes get arrested for undisturbing the peace.

The police are bound by the Bill Of Rights to tell anyone they arrest they have the right to remain silent. So yeah.
