If he was in the wrong then his insurance company will contact you for a phone interview then tell you what place to have your car examined to see how much its worth now. If its totaled, then they will pay only the depreciated value of your car, judging it by mileage, interior condition, etc. They will also take your car from you since they just "bought" it unless you want to pay a portion of your settlement amount to keep it. As far as any medical bills or other damages you want to get money for you will have to contact a lawyer.

The fact that he has liability insurance means that his insurance will cover the damages to your car and in some cases, injury to you if any. Liability insures that the person at fault (meaning him if the accident is his fault) doesnt have to pay out of his pocket to fix your car and person. Usually the insurance company sends you a check after the insurance company sends an appraisor out to access the damage. You most likely will not have to pay for a thing. All you need to do is call the number he gave you or if he gave you an insurance card, call the number..they will tell you what will happen next. Good luck. sorry this happened.

Do you just think it was his fault or did he agree or was there a police report or witnesses.
If there is no disagreement about fault , you should have no problems, and his insurance will pay for your damages. If there is a disagreement about fault, your insurance will cover amounts over your deductibles and/or negotiated with his company.
Unless you or your baby were injured a lawyer will cost more that you have to gain by suing.

If the accident was his fault, his liability insurance is supposed to pay for you. If his insurance company does not want to pay, then your insurance company will go after his insurance company.

Do NOT admit any fault in this accident, and do not allow yourself to be recorded by his insurance company over the phone.

Talk only to your insurance company. If you have problems with his insurance company, or you do not have insurance, then file a complaint with the "Insurance Comissioners Office"
