It is only illegal if McDonalds would want to press chares which they would have every right to do so. When you enter a McDonalds parking lot you are entering private property, it’s the same concept if somebody walked onto your property and started taking pictures of your house and any belongings of yours sitting outside your home. The argument may come up that they are open to the public, but they are only open to do business with the public and that is all.

In response to Answer #10 about them filming you on surveillance cameras. McDonalds and any other company are required to post warning signs on the property that you may be under surveillance while there. Equally so the employees, and the people shopping at McDonalds need to be warned that you are filming them!

On a side note you may stand on the street and film in the direction of McDonalds or on a neighboring property but once you step foot on their property you may be fined or arrested, and have your equipment confiscated.

I doubt it - especially from the outside - because it is visible to the public anyway. I wouldn't put something slanderous on utube or anything though.

If you film the staff inside and wanted to release the film in some way you might need to get release forms.

No, but you should get a released signed by anybody you capture on film before you make it into a movie for public viewing.

without explicit permission it is illegal...It is private property...If you film off grounds then you are fine
