My husband and I are separated, he's in Japan (Air Force) , I'm in the states, we're divorcing and we've been separated for the past 2 years, yet I went to do my taxes yesterday and found out that he has put me as a dependent, yet I get nothing from him nor does he support me. I work and I don't depend on him, so is it legal for him to do that without my consent? Only serious answers please..I'm curious to know.. Thanks..

No it is not legal for you to be listed as his dependent. Your spouse is NEVER your dependent. Paper file your taxes as married filing separately and the IRS will do an investigation. Not to worry, it is his butt that is in a sling not yours.
Yes, contact the IRS. Just to give them a heads up. Call your husband to let him know that you have let the IRS know he fraudulently filed his taxes. Don't be smug or evil about it on the phone, just say this is a FYI.
Example: "Bob, I am filing my taxes married but separate. The IRS will be in contact with you shortly concerning the tax return you filed with me as your dependent. That wasn't legal and there will be legal ramifications." He will probably try and start a fight and tell you that you are wrong. Don't fight, just say, "Bob, this phone call is just an FYI. Good bye." Hang up. If he gives you hassle after that, then contact his 1st SGT.

I've been married for over 16 years & have not worked most of those years. Every time we've filed my husband does not "claim" me as a dependant. Even though I don't work we file jointly. So, he would have had to get your signature on the tax forms to file with you as an exemption. (Jointly)
As far as I know, and I'm not an expert, if you worked you have to file your own taxes, whether it be jointly with him or seperately. So, he's claimed you, but yet you have to file also. Just go ahead & file & do what you're suppose to do. Let it be on him when the IRS wants to know why he filed jointly with you.

Of course you have to know. Also you have to remember if he was supporting financially at the time. If he was then he could put you down as an dependent. If you file your taxes on your own the IRS might look at yet and it will get your husband in trouble.

It depends on what you claim on your taxes. If you both claim something different red flags will go up all over the place with the IRS. You might be able to hedge your bets by contacting the IRS and he may or may not get pentalies for trying to do that

You didn't mention whether your seperation was legal or not. If it's not in the eyes of the law you're not even seperated. Besides you are still LEGALLY married which makes you his dependant whether you get any type of support from him or not. If you don't want him claiming you as a dependant I suggest you file for divorce rather than just being "seperated".

Even if you were together, if you are working and receive your W2 form, you must file you taxes alone. He cannot possible claim you . married, separated, or divorced .. if you're working.. Plain and simple.
You won't have any problem, but he will and the IRS could get him for fraud.

no he cant do that, prove that youve been separated and go ahead and file on your own, if he got anything for you he`ll have to pay it back unless he can prove you two are together and he supports you.

have you ever not watched the information or examine the information paper the position the POLICE have done this and the guy confesses and not in any respect something is done?? anyhow, you does not be taking it to court, the police are likely now unlikely to do something about it. finally, you want to provide the state you stay in.
