My family purchased a home (12/06) it didn't have a side fence, we spoke to the neighbor (he had his house for sale) that we would be putting a fence(wood). He said we could do whatever we wanted. We put it (1/07)up with the nice part on our side, on 2/07 the new owner came up to my sister and told her ( very rudely) she, that the job was done wrong, that we had to put a row of wood along his side. He also said we should have talked to him, we didn't know the house had been sold! ( the for sale by owner sign is still up on the lawn. What should we do? Is he right? or just being a jerk?

I used to be a fence builder and some townships have ordinances that require you to put the post on your side if you are building it. I would check the local codes before I did anything with the fence. You might be ok since the previous owner said you could put it up that way.

One part of your question I do not understand. What does the neighbor mean when he says that you "had to put a row of wood along his side"? Does that mean he feels the nice side of the fence should be facing his house? Or does he want a row of wood on the ground running the fence line?

I'll guess he doesn't like having the view of the fence.

If you had the fence installed by a professional, the professional would know the laws in your town concerning the installation of a fence. You could always call them to verify.

If you didn't hire a professional installer, and did the work yourself, you can contact the building/zoning department in your town to find out about the requirements for fence installation. Every town has different zoning. In my town, a permit is required for a fence, and it can be installed nice side out or nice side in.

Just being a jerk, If it's your land you have every right to do what
you want to on and with it. If the neighbors have a problem just
tell them to get over it. And no you do not have to put a row of wood on their side. The fence was put up on your land giving you every right to build it as you wanted to. End of story!

so as long a the fence is under 6 feet and inside your property line you do not have to have any nice side showing towards his size, nor can he argue that the fence devalues his property

Probably not, but there is a possibility he can force you to do something. You should check into ordinances for the area you purchased your home. Also, look for subdivision covenants (which are pretty easy to find - it'll be filed at the local courthouse).

I think he's just being a jerk. As far as I know...you can put your fence up facing either way...it's your choice. It's on your property...so tough!! If he doesn't like it he can put up a fence too!!

as long as the fence is completely on your property and there's no local ordnance or neighborhood association rule againstit, i think he's just being a jerk.
