i have a tenant that went to jail and theres someone else staying in the appatment and the tenant hasnt paid rent in 5 months what can i do

If the person's name is not on the lease, and they are not related to the tenant by blood or marriage you can have them removed immediately(ie call the cops). You will then have to institute an eviction action to have the stuff removed. if the person does have a legal claim to be there, you will have to wait for the eviction action to take its course for them to be forced to leave.

Depends on a few things including a lease involved.

The lessee has not paid?

In Canada we have rental boards and specific rights of both landlord and tenant. There is a process to go through to make booting them legal.

I am sure your local sheriff office or city hall can point you in the right direction. No matter the circumstances, you are losing money and your tenant broke their agreement with you!

Why does this lessee not pay you?

Personally, I would learn my rights and then boot them asap.
I pray they have not trashed the place. Next time you rent, ask for refs and check on them. I have been in your shoes and it is a tick off!

Enjoy the $$...Until you get a release from the resident ( Not Tenant ) The unit is paid up for 5 months, after that, you can evict.

Go to court, file an eviction, kick the other person out, especially if they're not on the lease, and put his stuff in storage. When he wants the stuff back, he should have to pay the storage fee.

a person cant be there unless on lease so call the cops hes trespassing but be for you do don't pis off the wrong cine of people

have the rat evicted as soon as you pssibly can. eviction is long overdue!
