Almost 2 years ago, my ex-fiance and I got into a fight due to his infidelity...I went over to his house, and after a lot of yelling-he pinned me to the wall, and my reaction was to punch him-well he called the cops on me, and in the state of Texas-one party must go to jail in a domestic dispute. Since I was at his house, it was me...so now I have a Class C Family Assault Charge on my record and I am in an alternative teaching certification program to teach. Will this keep me from teaching? Do I need to give up while I still can? It's the same class as a traffic ticket but....PLEASE HELP!!!

You will still be able to get a certification, but you may not pass the background check. I had a friend who had to fight for a whole year because her background check came back with a flag... she had gotten a ticket (and pled guilty) because her dog hadn't been properly licensed.

It may be easier to get a job in a school system where they can't be as "picky". Perhaps an inner city job.

I couldn't find a specific answer about a class c misdemeanor conviction, but from what I've read, Texas has some of the toughest domestic violence laws. A lot of states are restricting anyone convicted of any domestic violence (not just felonies) from working with children, the disabled, and the elderly. This is true in Indiana, where I'm from.

If I were you, I'd talk with a lawyer about how your case affects you specifically, before you spend any more time or money pursuing something you may not be able to use. Most offer a free or low-cost consultation.

The assault charge - is it still only a charge or have you been convicted? A charge alone doesn't mean as much, but it could be a hindrance. Through the alternative certification program, you'll need to get hired before you complete your certification. I went through an ACP, and many schools were reluctant to hire me simply because I wasn't already certified.

I agree with the responder who said you should consult a lawyer. Or ask someone in the human resources department at another school district for their opinion.

If this does interfere with your plans, there is always civil action that you could take against the guy for messing everything up.

yes it does effect you i went throgh the same thing. kyou need to have it exponged

To get it expounged you first need to go to the court you went to. and obtain your "record" (it normally free) from there it best to see if you can go to a local legal aid agency because the might be able to help you for free. otherwise its about $60 i think to obtain the paperwork to file for an expungment. then you will see the judge and give your story. If you get approved you can legally say NO on applications when it ask on application, though yes it can still show up, when people see that it was expunged they are more willing to accept you or at least hear your side of the story and still consider you, its not as likely if you dont have it taken care of. Best of luck. and remeber the case has to be over before it can be exponged (not on probation or anything like that)

Probally it would be o.k. if you where in a different state that the one you got into trouble in. Thats if it is a state charge. If its a federal charge you won't be able to get certified because its a domestic. You also won't be able to get a gun permit or go into any type of police work.

That shouldn't affect you. People these days are worried about felonies on your record.
