does this mean if my aunt the "personal represenative" can give my brother and sister everything and leave me with nothing and the court will not do anything about it?

Also if my aunt can distribute the assets unfairly is there anything I can do about it?


heres a little back story if it helps:
My dad passed, had no wife, just me and my 2 siblings.
He left an unsigned will.
he had a buisness which was just sold for 206,000 and 2 houses
My aunt is the personal represenative of the estate/executor of estate

Each states' law in this area is a little different, but my understanding is that it just means that your Aunt may not have the duties of reporting to the Court that a P.R. may normally have -- the court will leave her alone to get everything done to administer the estate in accordance with the law.

Should she not properly distribute assets, you can certainly petition the court to ask for a different distribution, or to have her removed, or sue her for waste, etc., but the court will not get involved until asked.

You should check with an attorney in MI, who could quickly answer this question for you.
