Her legal rights are that she has to follow the court order or you could be held in contempt of court. If she doesn't want to see him she needs to go back to court and get the order modified.

I think that you should have a talk with her and find out why? If it is just because it is taking time away from her friends this is not a good enough excuse. If it is a valid reason like he is mistreating her or abusive in any way then I would support this decision. If this is the case you will probably have to go back to court. If she just doesn't feel like going you should have a talk with her and explain that this is her father and he is going to be really hurt by this and that she needs to keep going.

Legally, it depends on where you live. Laws vary by state. In Texas a 10 year old can legally choose which parent to live with in a divorce. Her and Dad need to talk and work something out.

If she does not want to go, she probably has a reason. Make sure it isn't a selfish "I'm 16 and you're not" type of reason. If it isn't, don't make her go. At 16, in most states, she can decide for herself. Call your local county Family Services and find out.

She doesn't have to. As soon as she turned 16, she had the rights to decide which parent she wanted to stay with and whether she wanted to visit the other more or less or whatever. She still has the rights. Let her decide, as long as the parent she wants to be with has good boundaries.

It depends on which state you are in. But if you present your daughter and she tells the father she does not want to go you have fulfilled your part of the Court Order. They cannot hold you in contempt if you have followed the Order and presented her. Hope that helps. (It works that way in Texas) Check your local laws to be sure!

She has a legal right to make a choice. trust me I went through that when I was young. All you have to do is go to the courts and have her tell the judge.

I never made my kids go with their dad once they were old enough to decide yeah or nay, but I did encourage them to at least spend the day with him and have him bring them home...
At 16, he doesn't have to go...and the dad should understand that, but your 16 year old has to be the one to tell his/her dad, you can't do it or the dad will be thinking you are the one deciding.

Maybe she can visit when she feels like it. She is probably a busy teenager. You can't force kids to visit parents if they don't want too. Forced love is not love.
