this person thinks the 2nd marriage is not legal because they were still maried to the 1st person. I say it's legal and they were a bigomist until the divorce from the 1st person went through. Do they have to divorce the second person to marry someone else? (a 3rd person)

As long as you are still legally bound to another person any second marriage is considered bigamy!

NO the second marriage is not legal at all and therefore is not a marriage. This is bigamy and punishable by prison. It is a crime. If the divorce was final before they married then it would be a legal and binding marriage. As of right now the second marriage is not legal and not even considered to be a marriage. They need to be divorce completely from the first spouse to marry anyone else ever. this second so called marriage is not a legal marriage so why should there be a divorce if the marriage is not even real and valid?

Until the 1st divorce is completely done in court~ they've gone for the final decree and the judge grants the divorce~ then the second marriage is not legal! As far as I know! But you may want to contact a lawyer and get their opinion and legal advice! Most consultations with a lawyer are free!

Of course you need to divorce the second person before marrying a 3rd to make it legal, just like you have to be DIVORCED from the first person to make the second one legal.

Sounds like the only valid marriage here is the 1st one.

You have to have a legal divorce to marry anyone.Getting married to anyone for the second time without a divorce is against the law and it would not be a legal marriage.

I'd say don't get involved with a guy that doesn't have the balls to divorce his wife and just hands out excuses. But, you can't go back in a time machine. So then I'd ask what is most important to you? Being with him or not being with him? Do you have a good relationship besides this giant issue? Sad for your kids that their own father doesn't have the sense to show them how a real man should be to the mother of his children. I find it very disrespectful to you and the kids. Let him know you want the divorce, not so much for getting married but for the fact that your kids are getting older and he should not be married to another freaking woman! He is going to get away with it until the end of time. I doubt he will do anything about it. He knows you will not leave. He knows you will not even threaten to leave. You will just fight about it until you are blue in the face. You might talk to his ex about it. Tell her how you feel and that you would like if she initiated it. I'm sorry but his lack of motivation is a red flag to me. If he died she would have rights to everything. You have nothing. That is a big point to bring up. What a jack *** he is.

Legally, you cannot marry another person until your current precedings for divorce have been completely dissolved. It is biggomy to marry while already married. It doesn't matter if the marriage is in divorce precedings, you are still married and NOT divorced.

It is not a legal marriage. it would not be considered a legal marriage in many states. Best to check with an attorney in the state in question.

As far as I know, you have to produce a divorce certificate in order to "legally" marry someone else.

The second marriage is null because they are still married to person #1. This sounds like a marriage destined for failure.
