It's funny that people think the Iraq war was illegal. Congress voted for the war based on intelligence from the current and previous administrations. Get over it, we will be at war for a very long time against people that do not conduct themselves by the rules of war. How was the American revolution won, by patriots that had to bypass the rules of war. Where we are as a nation now is nothing compared to where we were 200 years ago. We are failing as a nation.

Let our soldiers fight like they did in WW I & II. Only then can we win this battle.

By the military code of conduct a soldier should not follow an illegal order.

No war is illegal. War has been part of human nature for 1000's of years.

Who decides whether or not the order is illegal? Who decides whether or not the war is illegal? YOU? THE SOLDIER?

The soldier took an oath to obey orders when he was inducted into the military. He is duty bound to obey orders, regardless of whether or not he believes them to be illegal. That decision rests with a military court, and always follows after the fact... not during combat.

I'll wager YOU have never been in the military, never been in combat, never fired a weapon in defense of either yourself or your country. YOU are therefore ingorant of the facts of combat, and not qualified to judge, or even ask this question. You've never been in a foxhole, or defensive position with the enemy advancing.

Would you like to be in the position of having the enemy on top of you, and the soldier next to you say he was not going to fire, because he thought it was illegal to do so? If your answer is "yes", you're a fool... and you're also dead.

I'm waiting and hoping that the military reinstitutes the draft, so that all you bleeding heart, liberal conscientious objectors get a taste of what real military life is like.

a soldier is under no obligation to follow an illegal order. In fact he has a duty to refuse an order which he knows to be illegal, such as murdering unarmed civilians, or shooting wounded prisoners. As for the illegal war part, those are very difficult to prove, and involve a ruling in an international court of law, not just an opponent's declaration as to the perceived legality of a conflict.

No, there's an obligation not to obey illegal orders, but the National Command Authority (read: President of the US) decides what's a legal war. We have not ceded our autonomy to the UN or any other body.

Good question. But that's what soldiers do. Soldiers follow orders. If you go into the military knowing that you could be ordered to kill another man, you should know that your orders aren't bound by morality. If the orders aren't bound by morals, why disobey when they aren't bound by any other rule of conduct - like law?

No soldier should have to obey an illegal order. And, yes, this is an illegal war and an illegal order to go to war since the prez lied to congress and the american people about it. I'd say that is more grounds for impeachment and treason than a dress on an intern, would'n't you?

Has anyone forgotten 9/11? We were in Fact attacked on our own soil similar to the attack of Pearl Harbor! They enterd the matrix..if you are talking about that looser Lt...I wouldn't trust him around a broom straw....Leavenworth is Waiting with baited breath for him!

Your politics stop, when you wear a uniform. It's a volunteer military, he could have gotten out or gone IRR...no guts no glory....In WWII he would have been shot on the spot. He's doing the job of Tokyo Rose, during that time period with the help of the media. Stop bad mouthing your own country and countrymen. Find a solution to win!

No they are not supposed to obey illegal orders. Invasion / Occupation does not fall into that category.
