You may need to get yourself a lawyer. Your employer has no right to withhold your 1099 because you need that to file your income tax correctly. If you file an incorrect tax ammount, your going to be that one that has to answer for it. Good Luck!

Report the income anyway on 1040 Schedule C. Include a note that you didn't receive the 1099, including the employer's name and address.

If you don't remember the exact amount, be as close as you can. You can file an amended return later.

I had a similar situation. I had an employer who refused to send me a 1099. If he had sent it, I would have owed the IRS money. I just filed my return without it and got back $1300. It probably wasn't legal, but it worked out really well for me.

All you gotta do is call the IRS. Make sure you have enough identifying info on your employer. Name of company, address, etc.
