We are done paying on our bankruptcy plan. We were Chapter 13 for 36 months and we just made our last payment this month. Here is our problem: My husband totalled his truck last Friday and the insurance gave us $2756. Will we find used car places that will finance even though we have not been discharged from the bankruptcy?

I have placed this in the source box. There is a wealth of information there and a great free debt management software program. I bookmarked the site as I return to it often for the advice it offers. I hope this helps you.

Most creditors will not deal with a potential borrow who is still in a Chapter 13 bankruptcy. Your Chapter 13 plan probably does not allow you to incur any more debt without court permission. You or your attorney should contact the Chapter 13 and/or the clerk of the court to determine how soon you will get the discharge. If you don't have an attorney, get one.

You should get your discharge imminently if you completed your chapter 13 plan without any defaults. Contact your bankruptcy attorney, the chapter 13 trustee or the court clerk's office to find out whether the discharge order has entered, and if not, what can be done to expedite it. Entry of the discharge should be a ministerial act after you have completed performance without default of your chapter 13 plan.
