When the Confederate states surrendered it officially was no longer an act of war to shoot at yankess and therefore was violation of a civil crime.
This was all very subjective of course as some parts of the south didnt know the war was over for serveral years.
In other parts yankess were fair game once it got dark.

It was not legal after the war and it is not legal today. No state could then, or can now pass a law which superdedes Federal laws against murder. Congrats dude, that is definately the stupidist question I have seen on here today.
