Children take video cameras to school all the time. There is probably no law that would prevent a child from video/audio taping events at schools. The fact that it is done covertly should not necessarily be an issue. However, there may be issues if the video camera is used inside a restroom/lockeroom. Also, the school may have rules that would address this issue that would not make it illegal, but a violation of the rules. You may have to have the teacher's or school's permission to video and/or audio record lessons or other events.
As far as a child charging another child with assault; this is an ackward question. The word "charge" is a bit ambiguous. A child can certainly make an accusation of assault against another child. A child could file a police report against another child. A child could, in theory, make a citizens arrest of another child (I would strongly advise against this for many reasons, including the potential civil liability for the "arresting" child's parents). Also, the "charge" of assault is pretty specific and in many areas, carries with it certain factors that many people don't understand. For example, generally, assault is defined as, "a threatened or attempted physical attack by someone who appears to be able to cause bodily harm if not stopped." However, many states incorporate an intent element, others might include an element of imminent harm. Generally speaking, assault charges are generally not taken seriously unless they accompany a battery charge.

A parent can cause another child to be charged with assault if there is proof that the child did the deed. Legally, you can video anyone in a public place. However, for some odd reason, you can't legally audio tape people. Now, the laws regarding juveniles might be different so I guess you would have to check your local statutes.
Also, in recent readings, the law appears to be somewhat muddled as regards the electronics parts. If students audiotape their lectures with the teacher's blessing, supposedly it's okay. Also, if the government wants to tape you and the school district monitors the classroom with audio and video or the buses with audio and video, that's supposedly okay. However, it's still being done without the parents' permission.
Why don't you go to an attorney, have him go to the judge to get a court order to have the child wired for purposes of personal protection?
Oh, and why shouldn't U.S. Citizens think the way illegal aliens think? Anything is okay -- break any law you want so long as you don't get caught and if you get caught -- play dumb or claim lack of jurisdiction!

I know that you can take an audio recording, but the video recording might be considered as a form of entrapment. The video would b admissible in court, but the audio is not. As far as charging another person under the age of 16, I don't think you can do anything, but your parents can get hold of the juvenile authorities and they can charge the other child if it can be proven that they did anything to you.

I like your idea as far as discovering what may be going on that is contrary to your values and efforts to rear your child as you feel will be best in his or her interest.Transparent education should provide the average parent with a day to day accounting of what happens while your child is in the mandatory custody of the state and if a video audio film will do this it should be available NOW>.

A child can file a police report, the police decide on charges. The child CAN proactively file a civil suit. If your child is being bullied, get a lawyer and threaten to sue everyone concerned, the parents, the school, etc. Hit them hard its the only way to stop it.
If your child IS the bully, break his legs, he deserves it, and it will stop him from bullying others.

the wired part i have no idea i doubt you can do that it seems illegal but a good idea to me as far as charges i think it's a yes on this one harrasment physical violence depending on how old they are you might be able to get a restraining order to keep them away from your kid my son when he was in kindergarden had a kid who would constantly pick on him the school of course did nothing we went to new orleans one weekend to visit my step kids and my son really wanted this voodoo doll i was wondering why and he said he wanted to get back at the kid who was making fun of him so we let him and than we took the doll to school to show the teacher and principal and this kids mom just how much this was affecting our son let me tell you it worked and they removed this boy from his class and he also was much nicer to all the kids after that i guess when the tables get turned on you sometimes it's for the better do what you have to to save your son from this is time for us as parents to stop the bs before it turns violent good luck
