ck4829s pithy answer aside, the standard set by Plessy v Ferguson was "Seperate, but Equal". Here is a quote from the Majority opinion: "The object of the [Fourteenth] Amendment was undoubtedly to enforce the absolute equality of the two races before the law, but in the nature of things it could not have been intended to abolish distinctions based upon color, or to enforce social, as distinguished from political, equality, or a commingling of the two races upon terms unsatisfactory to either."

So, the opinion of the US Supreme Court, at that time (1896) was that there could be a SOCIAL distinction between the races, that did not infringe upon the requirements of the 13th and 14th amendments. Basically, this set the stage in the south for the separate restrooms and other public facilities for blacks and whites, which led to the creation of Jim Crow laws.

Plessy was a white man (7/8 white blood, meaning one of his great-grandparents had been black and all other grandparents and parents white) who was arrested for riding in an all-white "cracker car".

Ferguson was the bigot who said that race hatred and general southern stupidity took precedence over the US constitution.
