Your employer had to file a copy of the W2 with his earnings report and salary report. Therefore, if you have copies of prior W2s you can get the tax ID number from the form and request a copy. Also, I believe that if you have your pay stubs and the dates of employment, you can use them to figure out your income and the taxes paid and then attach a statement with your tax return that you lost the W2 or that the employer went out of business and you didn't get a W2 from him.

Otherwise, go see a tax attorney, an accountant familiar with taxes, call your employer for a copy, and/or call the IRS and request the information.

You can get into a lot of trouble for evading taxes, but if you make an honest effort to pay what you owe, and document your efforts (keep a list of names, dates, times, phone numbers and/or letters you sent to get the information) there is no intent to evade the taxes or file them fraudulently. SYA or CYA however you want to put it.

You do not need a W2 in order to file taxes. Do you have your last pay stub? With YTD gross income? Add both YTD gross incomes and file based on that. Tell the IRS that you do not have W2s.
BTW, keep in mind the IRS does have the copy of your W2s sent to them by both emplyers. Unless of course they lost them also.

You can try to call your past employer, they have to send you a w2 regardless of going out of buisness so you may not have gotten it yet. It can take time especially if they have someone else handling their past expenses. As for how to get another W2 you'll have to call your employer. It's all going to take time.
