Hello, I just began to rent a new apartment. My husband to be is currently on probation and because we were worried about this being an issue we did not include him on the lease. If he is in good standing with his probation and does not have any outstanding warrants, this does not violate anti-criminal rules for the apartment does it? I had to sign a waiver saying all tenants had to pass a criminal background check. Would he? Could we provide a letter from his probation officer, would that help? It's not like we are living in the hamptons, its a small complex near a community college.

You're not being stupid here, are you? Are you being honest with yourself about this man? Do you think that the love of a good woman [you?!] would have prevented him from getting into legal trouble?
What is he on probation for?
If you haven't already married him, you still have the opportunity to find a guy without a criminal record and you should do just that.

As a complex manager there are some things I would look at. First, what did he do? Violent or drug crimes get little wiggle room. Second, why were you not upfront when you signed the lease? If you thought he wouldn't pass, and you knew the rules of the complex, then you were essentially defrauding your landlord. IF you signed a waiver for all occupants to be screened, then yes he has to do it. By having him there with out notifying the office you have already violated the lease and are in breach.

It doesn't matter if you aren't in the Hamptons. The truth is people should be able to expect tenants to follow the rules. For you, this is no big deal because the rule isnt in your favor. Maybe your neighbor is runnign a meth lab and feels that the complex rules hinder his income ability. The rules have to apply to everyone or they apply to no one. If I were your landlord I would terminate the lease for breach. Sorry-just be upfront next time.
