My home is in foreclosure and would like to know how much longer I have before I get kicked out. I have not made a payment since August 2006 and this week I got a letter that they filed the papers and the court date is set for February 27, 2006. After that date do I have days, weeks or months before I have to leave??? I just want to make sure I am out before they force me out with a sheriff coming to my home.

I do not want to keep the house so it will be forclosed on and I am filing Bankruptcy and moving out of state. The flreclosure papers were filed and the court date is 2/27/07. Just wondering after that date how long I have to get out on average.

The bankruptcy laws have not changed that much at all. If your foreclosure was just filed, then depending on what state and county you live in depends how long you have. You have until a month after the sheriff sale date to get out of the house. In Cuyahoga County in Ohio it takes around a year for the entire foreclosure process.

They typically do not begin the official foreclosure proceedings until you are 3-4 months past due. They will threaten you with foreclosure but it is not until they actually hire an attorney and file the foreclosure paperwork in the court system that you are officially in foreclosure. The entire Foreclosure process can take at little as 21 days and as long as a year. This duration will depend on your State’s Foreclosure laws.

Did you consider selling your home? Although it is in foreclosure you can still do this. Many people don't realize this. I know you only have a few days but CONTACT THE MORTGAGE HOLDER!!! They would RATHER work with you than foreclose. Call them. Have courage and pick up the phone. I don't mean to be harsh, but clearly key in to reality and use the power you still have as a home owner. Sorry I didn't answer your question but I couldn't remember the exact number off the top of my head and I don't want to give you any misinformation. Also, call the sheriff's office and ask them. Be strong. Have courage even in the face of fear.

I thought Sleek's answer was a good one. You need a little tough love here. None of us know what your situation is, but we're willing to give you a little advice and support here.

In addition to the information already provided, there are home buyers who specialize in "short sales". These are investors who have cash available that can come in and buy your house before foreclosure and, hopefully, give you enough money to pay off your debt. Contact a local realtor and ask them if they know of anybody that may be able to help.

With the new bankruptcy laws, you may not walk scott free on your debts. Why not call a realtor right now and get your house listed for a quick sale? You might come out of it with some cash.

get a lawyer a.s.a.p. !!! foreclosure isn't something you want to mess around with.

ask the lawyer if filing for bankruptcy will help you keep a roof over your head. filing for bankruptcy stops a foreclosure action. also ask him if you can attack the foreclosure action, meaning did the bank serve you properly, if they didn't you can stop the action.
