Took delivery of a leather suite yesterday from a well known UK house furnisher....it has 15 defects, mainly where the leather has been damaged. Company are sending someone to have a look at it on Tuesday....do I have to accept a replacement or can I ask for a refund?
Your help would be appreciated and thank you.

No, they're not within their rights to insist on store credit. Under the Sale of Goods Act 1994 you're entitled to your money back, and it's the seller's responsibility, not the manufacturer's. If you've bought it for yourself (i.e. you're not buying it as part of a business) you can ask for a repair or replacement. The onus is on you though to prove that the goods are faulty.

I had a similar problem with a table delivered from a well known high street store that sounds like lohn Jewis. It was damaged on delivery and wasnt noticed until a while after, they gave me the choice of a replacement or £200 off. I took the money and paid a furnisher restorer £50 to repair it, good as new. I think you should negotiate a part refund for saving them from having to deliver it again. Legally the final choice is theirs, after all it is their sofa.

They might want you to take a store credit note. Whether or not you accept it is up to you, but they may be within their rights to offer you credit but not cash. Although if the suite was damaged on delivery it's their fault and they've basically broken the "contract" they made selling the furniture to you. If you want a refund ask for one. If they dither, threaten to go to a solicitor. Most of them offer free advice for the first 30 minutes.

You can get your money back if the product is not fit for purpose.

If you can sit on it and its likely to act as a sofa for a short while then its fit for purpose. Then they have the right to insist on fixing or replacing the sofa - thier choice.

yes you are intitled to a refund or a replacement. all things have warranties on them nowadays and as long as you report it straight away you should be fine, good luck.

They have to replace it but why did u not inspect it first??
they will want to sweet u i think or u could take action. make sure u take some pics of it.
