Could I sue BA for not controlling the pressure properly? His little chest exploded from the bags of yayo in his belly. Is there a precedence for this?

What nobody seems to be telling you is what I've learned over the years. At the incipient stages it is not about what "is the law" but much more about HOW you strategize.

Write a letter, write a declaration describing the conditions, attach any receipts, paperwork, statements etc in other words prepare a little packet.

Call BA headquarters and tell them - I have a pre-litigation dispute with you (don't say what) and I need to know WHO to write to directly. I am tired of getting the run around from your customer service supervisors".

Insist until you get the name, address and tel of an actual person like one of their solicitors or their LEGAL (not consumer service) affairs department. Make a copy and send the whole thing to them, registered. In the top letter be very clear and nonthreatening and make a demand. It would go something like this: "I am appalled at the treatment etc etc and plan to pursue all legal remedies available to me at this time. Please reply by (give them 3 weeks) or I will proceed with filing alawsuit in London Docket Court (or whatever it is called where you are).


If you don't know, say "the appropriate civil court for this case." Make it clear, say "I am not represented by counsel at this time but plan to be in the near future but in the meantime please communicate directly with me. The best time and place to reach me is (address, cell etc)." And send it off! There will be a bunch of back and forth etc but likely you can get a settlement offer for this terrible thing they did to your dear companion.

p.s. At about letter #2 (or letter 1 if you feel VERY aggressive) copy the whole thing to three BIG local news organisations and make sure the letter at the bottom prominently says so. Local news teams are usualyl best equipped and most interested in "dog down well" types of heartbreak stories.

Dude, I do not think you can establish that BA's negligence caused the dog's death, when you had placed the dog in peril by shoving drugs down his throat.

Note: I do not think everyone who answered this question knows whay "yayo" is.

I would definetely sue them, I am not sure there is a precedence, I have not heard of any similar cases, but you can sue them for necligence. You will have to prove it beyond reasonable doubt.

I think you could.What did BA expect to be in dog travelling from Thailand there should have taken reasonable care .

It's a shame it didn't happen on the way to Japan. I hear they have great recipes for dogs.
