My best friend is an attorney, and I asked him what the deal is. He says; in a situation like this you might as well pay the fine, and be done with it. The exceptions are as follows; The police camera points to the front of his vehicle, and he doesn't have anything on his camera. The camera doesn't work all the time, and is pointed in the wrong direction. Unless you have witnesses that will testify in your favor, it comes down to your word against his. In a court of law, who do you think they are going to believe? Knowing and proving are two different things. Because you know he was at fault, does not mean you can prove his guilt. You could employ an attorney, pay for your own investigation, search for witnesses, loose time from work/school, pay out an enormous amount to just prove your side of the case, and still end up on the loosing end of the deal. In other words, you could spend thousands of dollars, and still end up paying the fine, and having the points taken from you. You must weigh the differences between your ability to prove it, and would fighting it pay off in the long run. Either way you go here, you are going to pay out a lot of money. Economically speaking, you are better off to accept the fine, and go on with you life. If you stand a chance of beating it, then you might consider pursuing a court action. The police have pretty deep pockets when it comes to being legally protected in court, and how deep is your pockets or bank account? If getting the news media involved, and bringing forth witnesses that will go on camera in your favor could in fact make the officer rethink his stand on the situation. $500 and 4 points is way out of his legal rights. You know this, we know this, but without someone who will stand up for you, and testify you were in the right, doesn't leave you many options does it? One thing you might consider; Most businesses have cameras, and if you are lucky, maybe one was pointed in the right direction to caputre the event. You could play a game with the officer, and tell him you have a film that clearly shows he is at fault, and he has lied about what happend. Tell him; if he doesn't change what he is telling, and wishes to put his job in jeapordy, then you are prepared to take the film to the local TV station, and see what the public has to say about his actions on a cover up. You know he doesn't have a film, but he doesn't know you don't have a film either. Get to these stores, and businesses in the area BEFORE he does, and make your case before he has a chance to. You can trick him into coming clean, if you play your cards right. If not, then pay the fine, and be done with it.
