In a civil case, I filed an affidavit thorugh my advocate. Now I found that my affidavit will be in favour for the opposite party. When I contacted the another lawyer, he told me that the earlier lawyer has cheated me. What I can do? Whether I can take any action against that lawyer.

As an educated person whenever you put your signature on a piece of paper whether it is an affidavit or petition your are to verify that you understand the contents of such a document and affirm that these are true & correct according to your knowledge or as told to you & nothing is concealed or wrong therein. Why this verification is taken? Reason that you can ask your lawyer before putting your signature any thing which you don’t understand & make him to explain you why that thing is mentioned in the said document. If you fail to ask it will be presumed you understood all the contents mentioned therein as well you know that they are all correct & true to best of your knowledge & nothing is concealed or wrong therein. Now tell me what reply you will give to this question when asked by any authority whether Bar council of India, or any court that why did you not get your lawyers clarifications regarding the facts mentioned in the affidavit if they were in your favour,if they were true & correct submit ion regarding your case? It is very simple to say that all blame can be put on the advocate if things go wrong in your case but you file or defend a case because you know about the dispute & facts regarding the dispute for which the case is being filed or defended. Affidavit is not any simple piece of document which one put his signature it is a piece of document signed on oath & any incorrect summation in this make you liable for the offence of perjury that can be punished with imprisonment unto three years & fine under sec 193 IPC. Any how if you feel that you have been really got cheated by your advocate you can fill a complaint under the Advocate Act for his misconduct with the Bar council of India or your state where he is registered.

You never know a person he can cheat you in this world where people are mad about money even a brother cheats the other and a lawyer is even not your reletive he can cheat you. If something like this has happen you can definately file a case against him in the court for frauding.

Any 1 can cheant any 1. An advocate should not cheat his clients. You can complain the matter to Court, Bar Council of India, Advocates Assocation but it is very difficult to teach to lesson to careless person. Try to correct the mistake. Best professionals tries to satisfy clients.

You can complaint. Your earlier advocate cheated you it is against his professional ethics.
