she could go and tell police that i raped her? how could they know that she slept with me with her agreement , and she is aliar , how?

here's the thing.. if she signs a formal complaint against you.. you are going to be arrested..guilty or not. The actual "guilty" part will be determined by a judge and jury. This is where a lawyer and facts are going to come in. If she is a liar and slept with you consensually, there may be ways to prove this in court. Police have no say in guilt or innocence, they just enforce the law. If there are no complainants or if the offender of any given crime is unknown, then they must investigate and have evidence supporting their arrest. If this girl accuses you of rape and you are arrested, they will also investigate the situation and any evidence obtained either in your favor or not will come out in the trial. What normally happens in a situation of this nature, the girl gives a statement and may or may not be examined at a local hospital. If she wishes to sign a "complaint" then a warrant will be issued for your arrest. The police will bring you down and question you as well and arrest you. Everything you say to them will be included in the incident report as well as what she says to them.

Good question. If she agreed, there should be no tears are bruising in that area. They can tell, and will get to the truth. I am sure many guys have been charged and put in jail for having sex with a girlfriend, she gets jealous or mad or scared the parents will find out and yell rape. That is why you guys, you need to be careful. Getting raped is a bad thing, but being accused of raping a girl , when sex was agreed, then yelling rape, that is a bad thing too.

If the "action" was at her bedroom, without any intoxicating substances, and there is no evidence of forcible entry to her property, then she has to do the fast talking.

If the "incident" was perpetrated within some kind of space that you control, i.e. your car, your apartment, and/or any substances that impair mental choices was mentioned, well, you need to practice your best persuasive arguments.

Prior consensual activities between the both of you and/or her history with other partners weigh in your favor, but the fact should be established before coming to trial, as the new legal thinking bars cross-examination in the courtroom of this outside factor.

It's often a he said, she said case. And in he said, she said, it's very hard to prove guilt. That is why rape is so hard to prosecute in the USA.

In school, I did a project on the prosecution of rape. We selected a county in California. According to rape centers and such, there had been over 300 rapes reported in 1995. Of those, only about 100 went to a hospital for a rape kit. Of those 100, only 28 were reported to the police. Of those 28, only 2 were prosecuted. Of those 2, only one rapist was found guilty.

So I'd say you're probably pretty safe as long as she doesn't have any drugs/alcohol in her system and no signs of physical abuse.

Either from a Dr's medical report or a character check of previous sexual relationships. The med report would have to have findings consistent of a forcible entry--bruises, abrasives, semen, etc. If she has a history of being overly active, that might work against her & convince a jury she's unstable and not of good character, too.

Rape involves sexual activity

Sleeping involves....well, sleep.

I'm guessing that your question is "How can they determine if your sexual activity with your girlfriend was consensual".

Usually the first step is a "Rape Kit" which will turn up tearing and bruising and other factors which determine whether the girl was willing.

If she didn't report it until a week or so later, then it's her word against yours and not worth pursuing.
Unfortunately, once you are accused of rape, even if it never goes to court, the stigma stays with you for life.

A persons word means a lot, if she goes to the doctors after, her mental state will be noted. She isn't going to go to the hospital out of spite. Getting someone in trouble for something they didn't do would make that person really nuts.

If she has no bruises or abrasions they can probably tell you didn't force her. But, if you verbally force a girl to have sex with you through threats or persistence againsts her willingness then it is also considered sexual abuse. Hard to get charged with rape if there's no evidence though.

If you are sleeping with your girlfriend, she is not likely to be:

passed out
bruised
screaming for help
yelling "NO"
dead

I hope this girl is at least old enough that you don't go down for statuatory rape--she doesn't even need to press charges--the cops can do it without her.
