if some guy got me drunk and coerced me into having sex with him, is this considered rape? i was completely wasted. if i was sober i wouldn't even have been *talking* to this guy. he didn't use physical force but i did say no several times but he convinced me to do it anyway.

i found out later that that was his intention. this happened a couple months ago. but lastnight he actually spiked a girl's drink cuz she wouldn't sleep with him.that's why i ask, i feel kind of guilty that i'm letting him do this to other people.

Ethically?
Yes. You said no you said no therefore it would have been forced upon you. Your intoxicated, and was he? Either way I have a friend who was put in your exact situation and she is crushed from the fact. People are sick and twisted and will do anything for sex such as your situation. Now on the law side of things, it wouldn't be rape because there wouldn't be necessary proof and as you said he convinced you. Overall. Ethically rape? yes. In the eyes of court? doubtful.

perhaps. most places include terms in the statute that if the rapist (they're not really a rapist unless they perform the required action, but it's easier to refer to them that way instead of "the person who forced the unwilling sex") knew of the other party's mental incapacitation, it would be rape. It would certainly be true if he supplied the alcohol or forced you to drink it or slipped you a drug or something. But if you were voluntarily at a bar and were voluntarily drinking, you'll be responsible for putting the alcohol in your body and thereby lowering your own mental capacity. I'm not sure whether a court would allow you to collect or not. It wouldn't hurt to go get examined and call the police and stuff. I think for the most part that juries are pretty sympathetic to rape victims so the guy might get a guilty verdict even though it was your own fault that you were drunk.

OMG Do not listen to these people who say its your fault for any reason. Check your state law , contact an attorney FIRST!! You've already waited,so see the lawyer so he/she can get things done right -- to protect you. In my state (WI) at any point during intercourse, if a person says NO -- it as at that point that a rape is occuring. When a person says NO it NO right there on the spot!! Girl, Don't listen to any of these fools that say its any of your fault.

If he is still doing this to other women-- well, you didnt ask for this but some of those will be saved because of YOU!! Your not the first, I bet, and the other woman will not be the last. I hope you can find the strength to put an end to the offenders ways....

Regretting your choices is not the same thing as being raped. People who make such claims discredit women who actually are raped.

sure is go to the local ER and get a rape kit done make sure the nurse calls the police (if you are planning to file a compt and follow through with the investigation.... arrest of the suspect court all that if you aren't dont waste their time)

in the us law if you did not want to have sex and the person forced you to do it then yes it is considered rape. no matter how you want to look at it.

if you were conscious and you said yes, then no, it sucks but its not illegal, i'm sorry girl, if you said yes and then you said no and he forced you anyway then it would be rape or if you were unconscious

well, you were drunk, so it is partly your fault. dont be a drunk, and this wont happen.
