If I don't have a license for my business can i still sell things from my home? should i sell anyway?

Absolutely you are required to have a license to sell most any item in California- except for, I believe, your knowledge. (let us say you are an expert in your field and you sell your services to review a legal matter or be an expert witness in court trial).

You receive your permit from your local or county office of the State Board of Equalization. It is a simple thing to do. You do not need to show them a business license to get the permit. The permit is so the state knows who has a business in order to make certain you are collecting taxes from your customer. So any income you make be sure to include tax in your price and immediatly put the merchandise tax in a bank account that you open (in your name ok). Do this regualarly as people whoo do not get thereselves in trouble by having a good amount due at the end of the year. I beleive you report earnings quartely to the board but it could be yearly.

Once you have a sellers license an advantage is that you can purchase your merchandise at whole sale cost and not pay taxes on it... until the end buyer finally purchases. When you get your permit, make it broad on what you are selling... lets say you have a small business that sells art, gift items, and miscellaneous other items such as clothing of furniture.--- this way you can use it, according to the Board of E on buying and selling most anything and you are not limited to selling only 'cigars'.

If you buy things or make things and sell them you should have a license and collect sales tax.

If you are working as an affiliate for a company and selling things via a website, what you are getting is considered a commission or independent consulting fee. You will be getting a 1099 which will allow you to pay taxes on your income.

You usually need a business permit from your city as well as a reseller's permit from the state. Neither one costs much. The city may deny you a business license if you are selling from a residential zoned area and you will have customers coming to your house. Selling without the permits will hurt you very badly (financially) if you get caught.
