mostly how do they prosecute them...
not by what they did..
the majority.

1) Police get evidence against all suspects.
2) One suspect has more evidence, reason, and ability to do
crime.
3) suspect arrested if enough evidence.
4) the judge places money you need to pay to get out of jail
before trial. If really bad crime it the money may be excessive
or may be waived.
5) Trial by jury (12 strangers) or possibly by judge.
6) Found guilt or not guilty.
7) If the suspect is found guilty, then sentences for jail or other
punishments are given to the suspect.

They prosecute using the Adversarial system and try to apply due process in every case. Anything more then that you would have to be more specific
