she's married 5 years , he has three grown children, and their very educated, his daughter is executive of the estate, and he did have a will , when he was alive they both had the same lawyer, she called him today and he said he was the lawyer for his children and that she doesn't need a lawyer, can she get screwed if she doesn't have a lawyer representing her?

Get a lawyer even if she says she doesn't need one, it's just being careful.

The lawyer representing the estate usually cannot represent any of the beneficiaries individually. If she feels there are going to be problems probating the will or that she may not be treated fairly, it would be in her best interest to contact another attorney and have him or her review the will and any pre- or post-nuptual agreements. After the initial consultation, she can decide if she feels it is necessary to have the new attorney represent her in the probate proceedings or if things look on the up and up and she doesn't really have much to worry about.
Its really all going to come down to what is in the will and the relationship with the 3 grown children. If there is any animosity between the stepmother and the 3 grown children or if there is a chance someone may contest the validity of the will, your sister should not hesitate to contact a new attorney. Paying a couple thousand dollars in attorneys fees now may save her ten times that in the long run.

Tell her to at least consult with another lawyer. She does have some rights especially since there was no will.

get a lawer asap dont buy into that you dont need one if it was try then the kids wouldnt need one either
