I'm going to mail two copies already signed by me to them: one for them and one for me.

So who notorizes it while signing: me, the other party, or both?

The purpose of notarization is to vouch for the signature(s), that you are who you say who you are. You will have to produce a government-issued ID (such as a driver's license) to the public notary for verification. He/she will then put his/her stamp on the piece of paper that you sign. He/she vouches that you have appeared before the public notary and that you sign the paper in his/her presence. The contents is not the issue here. The public notary certifies your identity, that's all.

By definition, then, notarization is done by an independent 3rd party.

Whether the other party needs to notarize their piece of paper is up to you .. do you trust that they are who they say they are?

In general any document may be notarized. A notary is required to obtain a photo identification, or personally know the person who is signing the document. He may not, or shouldnot, sign anything pertaining to himself, for reasons of ethics. There may be some variations from state to state, but these are generally accepted rules.

A lawyer can witness/notarize for a small fee, could be worth the investment.

A notary is independant and will witness both signings...it does not matter who got the notary.

Get a lawyer.... any document that you want to be binding should be looked over by a lawyer... it's for your own protection.
