While crossing at a crosswalk yesterday, I got hit by a car. The driver was speeding and did not even slow down for me, according to several witnesses. The cops told me it was most definitely his fault.

However, I was amazingly not that badly hurt. I think all my winter clothes protected me from anything too serious, so I am basically just bruised all over and sore... can't really move a whole lot.

Everyone is telling me to sue the guy. Obviously, I want to recover for my medical bills and some damaged property. But beyond that, can I actually sue him (or his insurance company) for anything? Should I get a lawyer?

Oh yeah... and the road was not well plowed. As a result, I couldn't step back when I tried to because I couldn't get any traction, so I just slipped.

I hope you do some basic things before you go on a vengeance trip against the person who hit you. By your note it sound like you may have been the victim of a "hit and run." In this case I hope you got the license plate number so you can identify the driver of the vehicle that hit you. With a copy of the police report in hand and any other evidence (cameras in the area?), this would be a case that an attorney would be happy to pursue.

If the person driving the vehicle stopped and gave you his or her name and insurance information you don't have to have a lawyer to have your related medical bills paid for--just send them to the driver's insurance company.

You may not get any help if there is a chance that you were at fault. If you were "jay-walking" i.e. close to the intersection, but not really AT the intersection, or you were crossing against a red light, even if the driver of the vehicle was "speeding" you are considered as part of the "cause" of this incident and may not even get all of your medical cost covered!

No matter what it would probably be worth "consulting" an attorney. Most attorneys will hear you out for free or for a minimal charge. Remember the driver's insurance company will investigate the accident and may investigate YOU if you make a claim! Be prepared!

If I were you i would wait a few days and see how you feel. Injuries can surface a few days later. Did you see a doctor or go to the hospital? Definitely talk to a lawyer to make sure he at least pays for your medical bills. I'm guessing you could get more than that out of the guy, but thats up to you.

hey you got a good case ...... you will recover money for your medical bill miss work and pain and suffering ...... i am in the middle of a case right now and i looking at a couple of dollars ...... sue the loser he should have been watching where he was going .... plus the next time its might be a kids .....good luck with your case !
