In my G/F's divorce agreement, her x-husband pays 60% of the medical bills for their children, while she pays 40% (After insurance, of coarse). Anyhow, the bills seem to be mostly in her name, to where if she pays her 40%, then he still is not obligated to pay, being that the collectors will still come after her rather than him.
Is there a way for her to get the bills switched over to him after paying her 40% so that she doesn't have to get any bad credit in her name, and he is still forced to pay the bills?

She cannot put the bills in his name for medical bills that she incurred for the kids. She should send him copies and ask that he pay his 60% to the provider. Or, she can pay all of it and ask for reimbursement. If he does nothing she can take him back to court for contempt.

He would have to set the bills up in his name with the doctor's office or clinic. Other than that, the guardian bringing in the child and signing for the child to be seen will owe the bill, regardless of court order. The effect of the court order is that if he doesn't pay his 60 percent, she could sue him for contempt of court order.

Unfortunately The answer is No. She is responsible for the bills if she has primary Custody. Her recourse is to sue him for the balance, or turn him over to the Child support collection agencies and ask that they garnish his wages, for the balance due. Things differ by state so find out what the state law is by visiting with a local attorney.

well what she can try to do is send them copies of this judgement and try to get the collectors to go after him but it will be difficult since they are in her name. also you need to send copies of this to the credit agent so they have it on record if it does go toward her credit
